Abstract

Discusses key issues relevant to sentencing procedure, including the burdens and standards of proof involved, the boundaries of Newton hearings, the mitigating and aggravating factors, evidence of local prevalence of a crime, and the use of victim personal statements. Considers whether a general guideline on sentencing procedure and evidence is needed.
